Thats not the idea, how do you know that what Kazuya is doing can send Scorpion back to the Netherrealm. Chances are, Scorpion will just flip off his mask and just go Inferno Scorpion on him, and then Kazuya would not even have a chance. Doing the same thing over and over again, Scorpion will know what to expect. Simple enough, yeah?

but kazuya could fly up and attack from way up so he cold just use the lazer in the sky...

It doesn't matter, Scorpion could just throw his spear at Kazuya and bring him down, or dodge the lazer in the sky. What matters is that Scorpion is immortal, cannot be defeated because he can't die and he won't stop until he gets what he wants.

Probably because its just a game. In a real fight, you probably wouldn't be killing Scorpion, all you would do is hurt him badly, lol. Then his body would be reincarnated in the Netherrealm.
